ZBA approves variance for 39 Wilson Ave parking project

Zoning Board of Appeals · Meeting of March 10, 2026

Spencer's Zoning Board of Appeals unanimously approves variance for 39 Wilson Ave. The board voted to allow construction of a retaining wall in the front setback at 39 Wilson Ave to support additional parking, with Town Planner Vivian Poplawski noting the property is already non-conforming and the variance permits expansion of that nonconformity. The variance was granted under section 5.2.6 of the Spencer Zoning Bylaw for the Lake Residential property, owned by Elizabeth Rafferty O'Rourke Rev Trust.

The applicant, Brendan O'Rourke, was not present. The board also tabled discussion of proposed amendments to ZBA Rules and Regulations that would require applicants to attend hearings.
